Terms of Use

Welcome to the QuickVox service (hereinafter referred to as the "Service", "We", "Our", "Us"). This document describes the conditions under which you (hereinafter referred to as the "User", "you") access and use the Service, including features that enable you to participate in chat rooms and publish user-generated content (UGC).

##1. Definitions

• User-generated Content (UGC): any texts, messages, images, audio, video, links or other materials that the User sends, posts or transmits through the Service.
• User is an individual registered in the Service in accordance with the procedure established in this Agreement. Account registration is carried out by a person who has reached the age allowed in accordance with the legislation of the Russian Federation for accepting the terms of the Agreement, and who has the necessary legal capacity for this.
• Chat(s): Service functions that allow Users to exchange messages, content, and participate in dialogues.
• Service/Service: The QuickVox platform, its web application, mobile application, API and related services.

2. Acceptance of terms

By using the Service, you agree to these Terms and Conditions. If you do not agree with them, please do not use the Service.

##3. Access and Account

• Access to the functionality of the Service is provided after registration and/or authorization on the Service, while additional conditions may be required for the User to obtain access to certain functionality of the Service. The Service informs the User about all such conditions through the Service interface and/or through this Agreement.
• You agree to provide reliable information during registration.
• If all registration actions are performed correctly and consistently, an account is created for the User on the Service. All actions performed by a User on the Service using his account are considered to be performed by such User personally. The User is responsible for all actions performed on the Service under his account.
• The User understands and agrees that after registering in the Service, other Users of the Service can search and find the User in the Service by searching for a short name. The User is also aware that information on the Service posted by the User about himself (first name, last name, profile picture(s), description of himself, etc.) may be accessible to other Users of the Service. The Service offers the User various privacy and security settings to limit the number of people who can contact the User, as well as to establish the desired level of data privacy.
• The Service does not initiate or influence the User's choice of the desired privacy level. The Service is not responsible for the use of User data by other Users who have gained access to such data in accordance with the privacy level chosen by the User.

4. Rules of conduct / User Content

When using the Service, the User must:

• comply with the provisions of the current legislation of the Russian Federation, the Agreement and other special documents of the Service;
• not to post information and Content (including links to them) that may violate the rights and interests of others and/or the provisions of the current legislation of the Russian Federation;
• before posting information and Content (including, but not limited to, images of other people, other people's texts of various contents, audio and video recordings), pre-evaluate the legality of their placement;
• keep confidential and not provide other Users and third parties with personal data that has become known to them as a result of communication with other Users and other use of the Service (including, but not limited to, home addresses, phone numbers, email addresses, passport data, banking information) and information about the private lives of other Users and third parties without obtaining the appropriate prior permission of the latter. If there are doubts about the legality of certain actions, including posting information or providing access, the Service recommends that the User refrain from doing so. The User is prohibited from using the Service.:
• to mislead Users, the Service, and other third parties about their identity by using the data of another User or a third party, including the Information and Documents specified in clause 6.2.1. of the Agreement;
• misrepresent information about yourself, your age, or your relationships with other people or organizations;
• upload, store, publish, post, provide and send through the Service Content and/or information that:
  (a) contain threats, calls for violence, including hidden ones, approval and encouragement of violent actions;
  (b) contain pornographic images and texts or scenes of a sexual or other unlawful nature, including those involving minors;
  (c) contain a description of the means and methods of suicide, any incitement to commit it;
  (d) promote and/or contribute to inciting racial, religious, ethnic, political hatred or enmity based on their gender, orientation, as well as other individual characteristics and characteristics of a person (including health issues);
  (e) contain extremist materials;
  (f) promote criminal activity or contains advice, instructions or guidelines for the commission of criminal acts;
  (g) contain advertisements or describe the attractiveness of using narcotic substances, information about the distribution of drugs, recipes for their manufacture and tips for use;
  (h) may potentially lead to the commission of illegal actions by misleading Users or abusing their trust;
  (i) contain software viruses or any other computer code that may harm the Service, the operation of the Service, or Internet users in general;
  (k) are unsolicited promotional materials or any other forms of imposition;
  (k) in any way imitate any person, organization or official, including a Service;
  (m) and also violate other rights and legitimate interests of citizens and legal entities and/or requirements of the legislation of the Russian Federation;
• carry out mass mailing of messages to other Users without their prior consent and/or any other similar unsolicited mailing (spam);
• use the software and perform actions aimed at disrupting the normal functioning of the Service or User accounts;
• download, store, publish, distribute and provide access to or otherwise use viruses, Trojans and other malicious programs;
• use automated scripts (programs, bots, crawlers) without special permission from the Service to collect and/or extract information in the Service and/or interact with the Service and its functionality, reverse engineer, decompile, reverse assemble, modify, duplicate, create copies, create derivative works, distribute or provide to other persons, the software or other information available, obtained or extracted from the Service or any part of it (with the exception of Content uploaded by the User himself);
• in any way, including, but not limited to, by deception, abuse of trust, hacking, trying to gain access to another User's data used for authorization;
• carry out illegal processing, including collection of personal data of other persons;
• reproduce, duplicate, copy, sell, trade and resell access to the use of the Service for any purpose, except in cases where such actions were expressly authorized by the User in accordance with the terms of the Agreement or a separate agreement with the Service;
• to carry out independently or on behalf of other Users using the functionality of their profile, including by misleading or promising encouragement, using any programs, automated scripts, mass similar actions aimed at artificially increasing the indicators of the Service counters (number of contacts, voting results, reactions to messages, etc.).
• We reserve the right to delete, block or suspend access to the Content or account in case of violation of the rules.

##5. User-generated Content (UGC) and Licenses

• By downloading or publishing UGC, you grant us (and our partners) a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute and display this UGC within the boundaries of the Service.
• You guarantee that you have all the necessary rights to UGC, and that its publication does not violate the rights of third parties.
• We are not obligated to review or approve UGC, but we reserve the right to remove or reject any material.

6. Intellectual property

• The Service and all its components (software, design, logos, etc.) belong to us or the licensors. All rights reserved.
• The User is not granted the right to use trademarks or other brand elements without our written permission.

##7. Limitation of liability

• The service is provided "as is" and "whenever possible". We do not guarantee that the Service will be uninterrupted, secure, or error-free.
